You have the legal right to request a copy of the information we hold about you, in line with the Retained General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. You can request your information free of charge, although a reasonable fee may be charged in some cases, for example if repeated requests are made.

Accessing personal information about your child

Information about children may be released to a person with parental responsibility. However, the best interests of the child will always be considered. Even if a child is very young, data about them is still their personal data and does not belong to anyone else. It is the child who has a right of access to the information held about them.

Before responding to a request for information held about a child, we will consider whether the child is mature enough to understand their rights and, if so, we will respond to the child rather than the person with parental responsibility.

Accessing Information about someone else

You may only access information about someone else if you are an authorised representative, have parental responsibility, are acting on behalf of that person, or there is a lawful basis for the disclosure.

Request your record using our online form

Alternatively, you can download the subject access request form, fill it in with as much information as possible to enable us to locate the information you require and return it to us, along with copies of documents that confirm your identity. Please do not post original copies. Further information, including acceptable types of identification documents can be found on the Applicants Guide SAR – July 21.

If you prefer, you may also make a verbal request for your records either by contacting your health professional, or by contacting the Information Request Team on (0116) 295 5296. If you choose to make a verbal request, this will be confirmed back to you in writing to ensure we have understood your request correctly.

How long does it take?

The Trust has one month in which to respond to your request. However, we will endeavor to respond to your request as soon as possible. Where a request is identified as being complex, we will advise you of this and the Trust has a further two months to respond.

What to do if you are not happy with the response/experience

If you are unhappy with the response that has been provided to you or with the service you have received through the process, you can contact the Data Privacy Team via email and a response should be received within one calendar month unless otherwise advised – lpt.dataprivacy@nhs.net 

If, following this, you remain dissatisfied with the response to your complaint; you have the right to ask the Information Commissioners Office to review your case who can be contacted by:

  • calling the helpline on 0303 123 1113 (Mon-Fri 8:30am-5:30pm);
  • online at ico.org.uk/make-a-complaint/;
  • by writing to them at The Information Commissioners Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF.
