The Data Protection Act 1998 gives individuals the right to know whether the Trust is holding or processing information about them. Patients who wish to see what is written about them in their health records have a legal right to do so, subject to given exemptions and unless there are compelling reasons to the contrary.
An individual does not have the right to access information about someone else, unless they are an authorised representative, have parental responsibility, or are acting on behalf of that person.
The Trust is not required to respond to requests for accessing health records unless it is provided with sufficient details to enable the location of information and to satisfy itself as to the identity of the individual making the request.
